Terms of Service

Effective Date: January 2, 2026 Last Updated: January 2, 2026 These Terms of Service (“Terms”) constitute a legally binding agreement between you and Ten for Ten, LLC, doing business as Hallway (“Hallway,” “we,” “us,” or “our”), governing your access to and use of our websites, applications, and services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Acceptance of Terms

By creating an account or using our Services, you confirm that:
  • You are at least 18 years of age
  • You have the legal authority to enter into these Terms
  • You will comply with all applicable laws and regulations
  • If acting on behalf of an organization, you have authority to bind that organization

2. Description of Services

Hallway provides an AI-powered voice research platform that enables you to:
  • Create and manage research projects
  • Conduct AI-moderated voice interviews with research participants
  • Collect and transcribe interview recordings
  • Generate AI-powered insights from interview data
  • Export and manage your research data

3. Account Registration

3.1 Account Creation

To use certain features, you must create an account by providing accurate and complete information. You are responsible for:
  • Maintaining the confidentiality of your credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

3.2 Account Security

You agree not to share your account credentials or allow others to access your account. We are not liable for any loss resulting from unauthorized use of your account.

4. Acceptable Use

4.1 Permitted Uses

You may use the Services for lawful research purposes, including:
  • User research and product feedback
  • Customer interviews and discovery
  • Academic and market research

4.2 Prohibited Uses

You agree NOT to:
  • Use the Services for any unlawful purpose
  • Collect sensitive personal information without appropriate consent, including:
    • Health or medical information
    • Financial account numbers
    • Government-issued identifiers
    • Information revealing racial or ethnic origin, religious beliefs, or sexual orientation
  • Conduct research involving minors (individuals under 18)
  • Interfere with or disrupt the Services or servers
  • Attempt to gain unauthorized access to any systems
  • Reverse engineer, decompile, or disassemble the Services
  • Use the Services to develop a competing product
  • Sublicense, resell, or redistribute the Services
  • Use automated means to access the Services without permission
  • Transmit malware, viruses, or harmful code
  • Harass, abuse, or harm others through the Services
Sensitive Data ProhibitionHallway is not designed for collecting or processing sensitive personal information as defined by GDPR, CCPA, or similar regulations. Do not use our Services to collect health data, financial information, or other sensitive categories without ensuring appropriate safeguards and legal basis.

5. Research Participant Terms

5.1 Your Responsibilities

When conducting research, you are responsible for:
  • Obtaining appropriate consent from participants
  • Providing participants with accurate information about your research
  • Complying with applicable privacy laws and regulations
  • Handling participant data in accordance with your privacy notices

5.2 Participant Data Ownership

You retain ownership of all data collected from your research participants. Hallway processes this data on your behalf as a service provider.

5.3 Participant Requests

You are responsible for responding to data subject requests from your research participants. We will assist you in responding to such requests as required by law.

6. Intellectual Property

6.1 Your Content

You retain ownership of all content you submit to the Services, including:
  • Research project configurations
  • Interview guides and objectives
  • Data collected from research participants
  • Insights and reports generated from your data
You grant Hallway a limited license to process this content solely to provide the Services.

6.2 Hallway’s Intellectual Property

Hallway retains all rights in the Services, including:
  • The platform, software, and technology
  • AI models and algorithms (excluding outputs specific to your data)
  • Trademarks, logos, and branding
  • Documentation and user interfaces

6.3 Feedback

If you provide suggestions or feedback about our Services, we may use it without obligation to you.

7. AI Features

7.1 AI-Powered Services

Our Services use artificial intelligence for:
  • Voice conversation handling during interviews
  • Automatic transcription of recordings
  • Insight extraction and pattern recognition
  • Research synthesis and summarization

7.2 AI Limitations

You acknowledge that AI-generated content:
  • May contain errors or inaccuracies
  • Should be reviewed before relying on it
  • Does not constitute professional advice
  • May vary in quality based on input data

7.3 Third-Party AI Providers

We use third-party AI services (ElevenLabs, OpenAI) to power certain features. These providers process data according to their terms and our data processing agreements. See our Subprocessor List and Privacy Policy for details.

8. Payment Terms

8.1 Fees

Certain features may require payment. By subscribing to paid features, you agree to pay all applicable fees.

8.2 Billing

Fees are billed in advance on a recurring basis. You authorize us to charge your payment method for all fees.

8.3 Refunds

Fees are generally non-refundable, except as required by law or as expressly stated in these Terms.

8.4 Price Changes

We may change our fees upon reasonable notice. Continued use after a price change constitutes acceptance.

9. Term and Termination

9.1 Term

These Terms remain in effect until terminated by either party.

9.2 Termination by You

You may terminate your account at any time by contacting us at [email protected].

9.3 Termination by Us

We may suspend or terminate your access if you:
  • Violate these Terms
  • Fail to pay applicable fees
  • Engage in conduct that harms our Services or users

9.4 Effect of Termination

Upon termination:
  • Your access to the Services will end
  • You may export your data before termination
  • We may delete your data after a reasonable retention period
  • Provisions that should survive termination will remain in effect

10.1 Data Storage

Your data is stored securely using industry-standard practices. See our Privacy Policy for details.

10.2 Data Export

You may export your research data at any time using the export features in your account.

10.3 Data Deletion

You may delete your research data using the purge features. Account deletion requests can be made by contacting us.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS
  • UNINTERRUPTED OR ERROR-FREE OPERATION
We do not warrant that the Services will meet your requirements or that AI-generated outputs will be accurate or complete.

12. Limitation of Liability

12.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HALLWAY SHALL NOT BE LIABLE FOR:
  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, or data
  • Business interruption
  • Costs of substitute services

12.2 Liability Cap

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF:
  • The amounts you paid to us in the 12 months preceding the claim, or
  • One hundred dollars ($100)

12.3 Exceptions

These limitations do not apply to:
  • Liability that cannot be limited by law
  • Your violation of our intellectual property rights
  • Your breach of the acceptable use provisions

13. Indemnification

You agree to indemnify and hold harmless Hallway and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from:
  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your research activities and participant data handling

14. Governing Law and Disputes

14.1 Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes shall be resolved through:
  1. Informal Resolution: Contact us first to attempt resolution
  2. Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration under the American Arbitration Association rules
  3. Venue: Any litigation shall occur in the courts of Delaware

14.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions.

15. General Provisions

15.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Hallway.

15.2 Modifications

We may modify these Terms at any time. Material changes will be communicated via email or notice in the Services. Continued use after changes constitutes acceptance.

15.3 Assignment

You may not assign these Terms without our consent. We may assign our rights freely.

15.4 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

15.5 Waiver

Our failure to enforce any provision does not waive our right to do so later.

15.6 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.
